Terms of Service
Effective date: 01.11.2026.
1. About us and these Terms
These Terms of Service (“Terms”) govern your use of g2ames.com, our games, and related services that link to these Terms (together, the “Services”).
The Services are provided by GRAVITY GAMES DOO (in English: Gravity Games Ltd.), trading as G²ames (“Gravity Games”, “we”, “us”, or “our”).
- Registered address: Nemanjina 57A, 12000 Požarevac, Serbia
- Company registration number: 21613207
- Tax identification number / VAT: 112134321
- General, legal and complaints contact: [Protecting...]
- Privacy and deletion contact: [Protecting...]
- Telephone: +381 12 541 022
Please read these Terms before using the Services. When you accept these Terms through a mechanism we provide, you enter into an agreement with us. If you do not agree, do not use the Services. Nothing in these Terms excludes rights or remedies that applicable law does not allow us to exclude.
2. Services covered
These Terms cover:
- Ginst – Arcade Music Game, also known as Ginst – Gravity Instrument;
- Ginst Kids – Music Game;
- Ginst Horror – Arcade Music Game;
- Ginst Tiles;
- BoomAHOY! Pirate Defense;
- zCoin: The Zen Path;
- Ginst Retro, including downloads and resources we provide for that project; and
- our website and associated support and online features.
They apply only on platforms where the relevant game is available. Features, purchases, advertisements, accounts, subscriptions, user content and multiplayer options differ by game, version, platform and region. A provision about a feature applies only where that feature is offered; it is not a promise to introduce it.
Separate terms may apply to a particular promotion, purchase or feature. We will provide them before you participate. They take priority only for the specific matter they address and remain subject to mandatory law.
Hardware products, including any Vayu controller, are subject to separate sales and warranty terms where offered. These Terms cover browsing information about them.
3. Age requirements and parental responsibility
You must have the legal capacity to enter into this agreement. If you do not, a parent or legal guardian must review and accept these Terms on your behalf where the law permits that arrangement.
Parents and guardians should select age-appropriate games, supervise children's use, and manage purchases, permissions and online interactions. Observe each game's applicable age restrictions. Ginst Horror includes horror themes and may be unsuitable for younger players; consult its current store rating and content description.
Content ratings, contractual capacity and the age for consenting to personal-data processing are separate matters. Parental acceptance of these Terms does not override an age restriction or replace verifiable parental consent where required by law. When processing depends on a child's consent and the child is below the applicable digital-consent age, we obtain the required authorisation from a parent or guardian before that processing.
3A. Ginst Kids
Ginst Kids is designed for children. Parents and guardians should read the Ginst Kids privacy notice at https://g2ames.com/ginst-kids/privacy-policy before allowing a child to use it.
We process children's personal information only for the purposes and on the lawful grounds described in the Ginst Kids privacy notice. We do not condition participation on a child providing more personal information than reasonably necessary for the activity.
We do not use children's personal information for behavioural advertising or cross-app tracking. If Ginst Kids contains advertising, it is age-appropriate and contextual. On Google Play, advertising shown to children uses eligible Families Self-Certified Ads SDK versions. In Apple's Kids Category, third-party advertising and analytics are used only within Apple's permitted exceptions; Google eligibility alone does not establish eligibility on Apple.
Purchasing opportunities and external links are reserved for an adult area behind a parental gate. Changes that enable additional sharing of a child's personal information require parental involvement and any legally required consent. A parental gate is not itself verifiable parental consent for data processing.
The general provisions about imported content, sharing, advertisements, rewards and external services in Sections 8, 8A and 10 do not authorise features inconsistent with this section or applicable children's protections.
If you believe we have collected a child's information without required permission, contact [Protecting...]. We will investigate promptly, stop unlawful processing and delete information collected unlawfully, subject only to retention specifically required or permitted by law. Parents may also contact us about access, correction, withdrawal of consent or deletion rights.
4. Permission to use the Services
Subject to these Terms, we grant you a limited, non-exclusive licence to use the Services for personal, non-commercial entertainment on compatible devices you own or are authorised to use. You may not sell, rent, sublicense or commercially exploit the Services without permission, except where law or a separate licence permits it. Authorised family sharing and similar platform features remain available under the relevant platform rules.
You are responsible for suitable devices, software and connectivity and any associated charges. Some features require supported sensors, permissions, an account or internet access. Check the published requirements before purchasing.
You must comply with applicable export-control and sanctions laws. You may not access, export, re-export or transfer the Services where doing so would violate those laws, including applicable restrictions concerning territories, persons or prohibited end uses. This provision applies only to restrictions legally applicable to the transaction or use; it does not impose a blanket nationality ban.
For Apple versions, Section 14 and the applicable app licence govern any conflicting licensing matter.
5. Accounts and saved progress
Provide accurate account information and protect your sign-in credentials. Do not impersonate others or use offensive, hateful or misleading usernames. Tell us promptly about suspected unauthorized access. You are responsible for activity you authorise, but are not automatically responsible for all unauthorised activity.
Save storage, purchase restoration and synchronisation depend on the features offered. Cross-platform transfers are not included unless expressly offered. Locally stored progress may be lost if you uninstall a game, reset your device or delete its data. Use supported backup features where available. This does not limit remedies for failures for which we are legally responsible.
5A. Account and personal-data deletion
For Ginst, you can initiate deletion through Ginst Menu > Settings > Account > Delete Account, or follow the web instructions at https://g2ames.com/ginst/delete-account/. You may also email [Protecting...] with the subject “Ginst – Account Deletion Request” and your username or Player ID. Do not send your password.
We delete the Ginst account and identifiable gameplay data within 30 days of the request. We may retain records required by tax, financial or other legal obligations for the required period. Other necessary and lawful retention, if applicable, must be identified in the relevant privacy notice with its purpose and duration. Retained data is restricted to that purpose.
Deletion is permanent and may remove linked progress, rankings, uploaded content and virtual items. We will explain material consequences before confirmation. Deletion does not extinguish statutory purchase or refund rights. We may reasonably verify that a request comes from the account holder or an authorised guardian, without unnecessarily obstructing it.
Deleting an account or uninstalling a game does not cancel a store subscription. Manage cancellation separately through the store to prevent renewal. You do not have to waive deletion rights or wait for a subscription to expire to request deletion.
6. Fair play and acceptable use
You must not:
- use the Services unlawfully, fraudulently or to infringe another person's rights;
- threaten, harass, exploit or abuse another person;
- submit offensive, hateful or misleading usernames or other content prohibited by Section 8A;
- cheat, use unauthorised automation or exploit defects to manipulate gameplay, rankings or rewards;
- create accounts to evade a suspension or other legitimate restriction;
- bypass payment systems, security measures, access restrictions or parental controls;
- access accounts, systems or information without authorisation;
- introduce malware, spam or deliberately disruptive traffic;
- distribute pirated copies or extract and redistribute protected materials without permission; or
- reverse engineer or modify software except as permitted by law or an applicable licence, including an open-source licence.
Report abuse, security concerns or unfair play to [Protecting...].
7. Intellectual property and third-party software
The software, artwork, music, arrangements, recordings, text and branding in the Services belong to us or our licensors. Permission to play a game does not itself permit extraction, redistribution, sale or public performance of its protected content.
Third-party and open-source components remain subject to their own licences and notices. Nothing here restricts rights those licences provide, including source-code access, modification, replacement or permitted debugging. Ginst's software notices identify FluidSynth under LGPL 2.1; consult the notices accompanying your version for the applicable materials and instructions.
Separate licences supplied with Ginst Retro source code or other downloadable resources govern the materials they cover. We reserve rights not expressly granted.
8. Imported music and user content
Where supported, you may import MIDI files, create musical content or submit material through the Services. You must hold the rights needed for your use. Availability of a file online does not establish permission to copy, adapt, upload, share or perform it.
You retain your rights in original content. Importing a file for local use does not transfer ownership or authorise us to publish it. Whether a feature transmits files to our servers is explained in its interface and privacy information; do not assume that every import remains local.
For content you submit to our servers or share through a supported feature, you grant us a non-exclusive, royalty-free licence to store, process, reproduce and display it only as necessary to provide that feature to the audience you select, maintain security and comply with law. You must be entitled to grant those permissions.
The licence ends when the content is removed from active systems, except for limited lawful retention and backup cycles described in the privacy notice. Copies independently saved by others may remain outside our control. This licence does not give us unrestricted advertising or commercial exploitation rights in your creations.
8A. Content standards, reporting and moderation
These standards apply to content you submit or share, including usernames, profiles, leaderboard names, song titles, links and creations. You must not submit:
- sexual exploitation material, sexual content involving minors, grooming or other child abuse;
- pornography or other sexually explicit content;
- threats, incitement to violence, terrorist recruitment or promotion of self-harm;
- hate speech, discriminatory abuse, bullying or targeted harassment;
- private information about another person without a lawful basis;
- unlawful or infringing material, impersonation or fraud; or
- spam, malware or deceptive links.
Educational, artistic or support-oriented discussion is assessed in context; discussion of a sensitive topic is not automatically promotion of harm. Content must also be appropriate for the relevant game's audience and rating.
We prohibit child sexual abuse and exploitation material. We take prompt protective action when identified and report it to competent authorities or designated reporting bodies where required by law. Reports should identify its location; do not download, copy or email abusive images to us.
Report content or conduct to [Protecting...], identifying the game, username or content location and the reason for concern. Use an in-game reporting tool where provided.
We review reports promptly and prioritise threats to safety. We may remove or restrict content, correct manipulated scores, restrict features or suspend accounts. Decisions take account of severity, context, repetition and the rights of affected users.
Illegal-content notices may be sent to [Protecting...]. Include: an explanation of the alleged illegality; a precise location, URL or other identifier sufficient to find the content; your name and email address, except where law permits omission for reports concerning child sexual abuse; and a statement that you believe in good faith that the information is accurate and complete.
For notices falling within an applicable notice-and-action regime, including the EU Digital Services Act where it applies, we acknowledge receipt when contact information is available, assess notices diligently and objectively, and communicate our decision and available redress. When legally required, a restriction notice explains the action, relevant facts and contractual or legal grounds, any use of automation and how to challenge it. Disclosures may be limited only where law permits or requires it.
Our electronic contact for users and authorities is [Protecting...]. Communications may be sent in English or Serbian. Where the DSA applies, this is our contact point under Articles 11 and 12; it is not a substitute for an Article 13 legal representative.
8B. Copyright complaints
Send copyright concerns to [Protecting...] with the work concerned, the allegedly infringing material and its location, your contact details and the basis for your authority. We may remove or disable infringing material and terminate repeat infringers in appropriate circumstances, subject to applicable law and review rights.
9. Purchases, virtual currency, subscriptions and refunds
Purchase screens identify the product, total price including applicable taxes, and material conditions before payment. Purchase only with an authorised payment method. Parents should use store purchase controls.
Where virtual currency is sold, we show its real-money price. Where items are purchased with that currency, we show their currency price and corresponding real-money cost clearly before purchase, including the basis of conversion where bundle prices differ. Offers must not obscure costs or pressure children to spend.
Virtual items and currency are licensed for use in the relevant game. They are not deposits or investments and cannot be redeemed for cash or transferred outside authorised features, except where law requires a refund or other remedy. Purchases are specific to the relevant game and platform unless stated otherwise before purchase.
Purchased virtual currency does not expire merely through passage of time or inactivity. If we retire a game or discontinue its use, we give the notice described in Section 13 and provide any refund or other remedy required by law for unused purchased balances.
The coin in zCoin: The Zen Path is a gameplay element. The game does not provide cryptocurrency, blockchain tokens, investment services or cash winnings.
If subscriptions are offered, the purchase screen states their price, billing period, renewal conditions, trial conversion and cancellation method. An automatically renewing subscription continues under the disclosed conditions until cancelled. Use the relevant store's subscription settings; cancellation normally prevents the next renewal while access continues for the paid period, subject to the disclosed offer and applicable law. Any price-change notice or consent required by law or store rules will be provided.
For store-billed purchases, use the applicable refund process:
- Google Play: https://support.google.com/googleplay/answer/2479637?hl=en
- Apple: https://support.apple.com/en-us/118223
You may also contact us about missing purchases, defective content or refund rights for which we are responsible. Store procedures do not remove our legal obligations. Purchases are not automatically non-refundable.
Where a statutory withdrawal period applies, immediate supply affects that right only after the legally required separate consent, acknowledgement and confirmation. Accepting these Terms alone is not a waiver. Rights concerning faulty, unavailable or misdescribed digital content remain unaffected.
10. Advertisements, rewards and external services
Where offered, advertisements or optional rewards are subject to the conditions shown in the relevant feature. Contact support if a promised reward is missing. Ginst Kids is additionally governed by Section 3A.
Third parties may operate advertisements, embedded media, community platforms, linked websites or services reached through an in-game browser. Their terms and privacy notices apply to their services. A link does not itself imply our endorsement. We do not control those services, but remain responsible where law requires.
11. Privacy
Our privacy notices explain personal-data processing, legal bases, retention and your rights. Consult https://g2ames.com/privacy-policy and the notice linked from the relevant game. Privacy requests may be sent to [Protecting...].
Acceptance of these Terms does not constitute consent to optional tracking, personalised advertising, non-essential cookies or other processing requiring separate consent. We request and manage such consent separately. The privacy notices provide information about processing and do not expand our contractual permission to use your content.
12. Safe use
For motion-controlled games, hold your device securely and allow sufficient space. Do not play while driving, cycling or doing anything requiring your attention. Use comfortable sound levels, take breaks and stop if you experience discomfort. Review content ratings and descriptions, especially for horror-themed games. These precautions do not limit our safety obligations.
13. Updates, changes and retirement of Services
We may update the Services to address defects, security, compatibility, legal obligations, gameplay balance or improvements. We provide updates required by applicable law. Some online features may require installation of updates.
For legitimate technical, legal, security or operational reasons, we may change or retire features or games. We respect purchase commitments, promised supply periods and mandatory consumer rights; giving notice alone does not release us from those obligations.
We will normally give at least 30 days' advance notice of retirement or a material reduction in paid functionality, where practical, using an in-game notice or email and a website notice as appropriate. A shorter period may be necessary for urgent legal or security reasons. We explain the impact on access, saved data, subscriptions and unused purchased balances and provide any required refund, cancellation or other remedy.
Experimental projects and previews may change during development. Future-feature descriptions are not release guarantees unless included in an express contractual commitment.
14. Apple App Store and Google Play
Store downloads and purchases are also governed by applicable store terms. Apple's Standard Licensed Application End User License Agreement applies to Apple versions unless a custom EULA is expressly supplied for that app. These Terms supplement it for the Services and do not silently replace it. The applicable EULA takes priority on conflicting app-licensing matters, without limiting mandatory rights.
Apple Standard EULA: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
For an app obtained from Apple's App Store:
- This agreement is between you and Gravity Games, not Apple. Gravity Games is responsible for the app and its content.
- The app licence is non-transferable and permits use on Apple-branded products you own or control under the Usage Rules in the Apple Media Services Terms and Conditions. Access by accounts associated through Family Sharing or volume purchasing is permitted where those rules allow it. These Terms do not impose conflicting usage rules.
- Gravity Games is responsible for maintenance and support promised by us or required by law. Apple has no obligation to provide maintenance or support for the app.
- Gravity Games is responsible for applicable app warranties. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund its purchase price, if any. To the fullest extent permitted by law, Apple has no further warranty obligation for the app; other claims, losses, liabilities, damages, costs or expenses arising from that failure are Gravity Games' responsibility to the extent applicable.
- Gravity Games, not Apple, addresses claims concerning the app or your possession or use of it, including product liability, failure to satisfy legal or regulatory requirements, and consumer-protection, privacy or similar claims. Nothing here limits that responsibility beyond what law permits.
- For a third-party claim that the app or your possession or use of it infringes intellectual-property rights, Gravity Games, not Apple, is responsible for investigation, defence, settlement and discharge of the claim.
- You represent that you are not located in a country subject to a US Government embargo or designated by the US Government as a terrorist-supporting country, and are not on a US Government list of prohibited or restricted parties.
- You must comply with applicable third-party agreements when using the app, including your wireless-service agreement.
- Apple and its subsidiaries are third-party beneficiaries of the applicable Apple-app provisions of this agreement. On your acceptance, Apple may enforce those provisions against you as a third-party beneficiary.
- Send app questions, complaints or claims to Gravity Games at the postal address, email or telephone in Section 1.
15. Suspension and termination
You may stop using the Services at any time and request deletion under Section 5A. We may restrict access where reasonably necessary to address serious breaches, fraud, unlawful conduct, security risks or harm to others, and may terminate access for serious or repeated breaches.
Where practical and legally appropriate, we explain the reason and allow an opportunity to correct it. Immediate action may be necessary if delay creates a risk or breaches the law. Content-related decisions and review rights are addressed in Section 8A.
Termination may end access to linked progress or virtual items, but does not automatically forfeit refund rights, unused purchased balances or other mandatory remedies. We will explain the consequences and apply any remedy required by law. Accrued payment obligations remain subject to valid disputes and refund rights.
16. Availability, warranties and liability
We provide the Services with the care and skill required by law. Temporary interruptions may occur. Except for express commitments and mandatory warranties, we do not guarantee uninterrupted access, error-free operation or compatibility with every device.
Nothing in these Terms excludes or limits liability for fraud, deliberate misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Mandatory digital-content rights, including correction, price reduction, cancellation and refund rights, remain unaffected.
For consumers in the EU, EEA, United Kingdom or Serbia, liability is determined by applicable law. To the extent that law permits, we are not responsible for losses that were not reasonably foreseeable when the contract was made or business losses arising from Services supplied for personal entertainment.
The following additional limitations apply only to business users and consumers outside the EU, EEA, United Kingdom and Serbia, and only to the extent lawful. They remain subject to the exclusions from limitation stated above and do not override express purchase commitments:
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE EXCLUDE LIABILITY FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING RESULTING LOSS OF PROFITS, DATA OR GOODWILL. OUR AGGREGATE LIABILITY ARISING FROM THE SERVICES IS LIMITED TO THE GREATER OF USD 50 OR THE AMOUNT YOU PAID FOR THE RELEVANT SERVICE, INCLUDING THROUGH AN AUTHORISED APP STORE, DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT PERMIT THESE LIMITATIONS; WHERE THAT IS THE CASE, THEY DO NOT APPLY.
Business users only: if your culpable material breach of these Terms or infringement through content you supply causes a third-party claim against us, you will reimburse reasonable, documented losses and legal costs attributable to that breach, to the extent lawful. We will notify you promptly, allow reasonable participation in the defence and take reasonable steps to mitigate losses. You are not responsible for losses caused by our fault, and we will not agree to a settlement imposing obligations on you without your reasonable consent. This indemnity does not apply to consumers and does not grant permission for otherwise prohibited business use.
17. Complaints, governing law and disputes
Serbian law governs these Terms. A consumer retains mandatory protections of the law that would otherwise apply in their country of habitual residence.
Submit a complaint to [Protecting...], by post to the address in Section 1, or by telephone at +381 12 541 022. Identify the game or purchase, describe the issue and requested remedy, and provide a receipt or other purchase evidence where relevant. Do not send complete payment-card details.
For complaints governed by Serbian consumer-complaint rules, we confirm receipt without delay and provide a reference. We respond in writing or electronically within eight days, explaining our decision and proposed remedy. Accepted complaints are resolved within the applicable statutory period, ordinarily 15 days; legally prescribed exceptions and any lawful pause or agreed extension are handled under those rules. We keep the required complaint records. These procedures do not restrict separate digital-content remedies or shorter deadlines required by law.
If a complaint remains unresolved, Serbian consumers may apply to a body listed by the ministry responsible for trade through https://vansudsko.must.gov.rs/. A prior complaint to the trader is required. We participate where Serbian law requires and provide the required information about available bodies. You do not have to use this process before going to court unless law requires otherwise.
Consumers elsewhere may use any applicable local dispute-resolution or judicial route. Consumer proceedings may be brought before courts having jurisdiction under mandatory law; there is no requirement to sue exclusively in Serbia where another forum is legally available.
For non-consumers, disputes are subject to the exclusive jurisdiction of the court having subject-matter jurisdiction for Požarevac, Serbia, unless mandatory law provides otherwise.
18. Changes to these Terms and notices
We may update these Terms for changes to the Services, legal requirements or legitimate operational needs. We publish the revised version and effective date.
For material changes affecting existing users, we normally give at least 30 days' notice through an in-game message or email, together with a website notice where appropriate. Urgent legal or security changes may require shorter notice; we will explain this where possible. Where required, notices are supplied on a durable medium and renewed agreement is requested.
Changes do not retroactively remove accrued rights or alter completed purchases. If you do not accept a material change, you may stop using the affected Service and exercise applicable termination and refund rights. Continued use is not treated as consent where express acceptance is legally required.
Other contractual or purchase notices may be delivered through an in-game message, your account email or another legally appropriate channel. A website posting alone does not replace individual or durable-medium notice where required.
19. General provisions
Events beyond reasonable control. We are not responsible, to the extent law permits, for failure or delay directly caused by an event beyond our reasonable control that could not reasonably have been prevented or overcome, such as a natural disaster, war or a major infrastructure outage. We take reasonable steps to reduce its impact. An ordinary supplier failure does not automatically qualify. Your rights to refunds or other remedies for undelivered paid Services remain unaffected.
Entire agreement. These Terms, expressly applicable additional terms and the relevant app licence form the agreement between you and us concerning the Services, subject to mandatory law and binding pre-contract information. Store terms govern your relationship with the store where applicable. Privacy notices explain data processing and do not create blanket consent or remove statutory rights.
Transfer. You may not transfer this agreement or your account except where a feature, platform rule or law permits it. Any transfer by us must preserve your contractual and statutory rights; we give any notice and choice required by law.
Feedback. If you voluntarily send non-confidential ideas or suggestions for improvement, you permit us to use them without payment or attribution obligations, to the extent lawful. This does not transfer ownership of user content under Section 8 or permit use of personal information beyond the applicable privacy rules.
Promotions. Contests, giveaways and promotions have separate official rules provided before participation. Unless expressly stated in those rules with the relevant company's authorisation, Apple and Google do not sponsor or administer them.
Severability and waiver. If a provision is unenforceable, the remainder continues to the extent permitted by law. A delay in enforcement is not a waiver.
Survival. Sections 7, 8, 8B, 9, 11, 16, 17 and 19 survive termination only to the extent needed to address existing rights, lawful retention, accrued obligations or disputes. The content licence in Section 8 ends under its own stated conditions; survival does not extend it indefinitely. Review rights concerning an existing moderation decision under Section 8A also survive for their applicable period.
